Agreement to Terms

By accessing or using the Red Valley Excavation website and services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our website or use our services.

Services Description

Red Valley Excavation provides excavation and earthwork services in Southern Utah, including but not limited to: residential and commercial excavation, trenching, grading, site preparation, land clearing, backfilling, and hourly equipment/operator hire. All services are subject to availability and site conditions.

Quotes and Estimates

Quotes provided through our website or in-person consultations are estimates based on the information provided and visible site conditions. Final pricing may vary based on:

• Unforeseen underground conditions (rock, utilities, debris)
• Changes in project scope requested by the customer
• Weather delays or site access issues
• Permit requirements or regulatory compliance

We will communicate any anticipated changes in pricing before proceeding with additional work.

Hourly Equipment Hire

When hiring an operator by the hour, rates begin from the time the equipment arrives at your property and end when work is completed. Minimum hour requirements may apply. The customer is responsible for ensuring clear site access for equipment delivery.

Customer Responsibilities

As our customer, you agree to:

• Provide accurate information about your property and project requirements
• Obtain necessary permits and approvals before work begins (unless otherwise agreed)
• Call 811 for utility locates before excavation work begins
• Ensure safe and adequate access to the work site
• Clear the work area of personal property, vehicles, and obstructions
• Make timely payments according to agreed terms

Payment Terms

Payment terms will be specified in your project agreement. For larger projects, a deposit may be required before work begins. Final payment is due upon completion unless otherwise agreed. We accept cash, check, and major credit cards.

Cancellation Policy

Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee. Please contact us as soon as possible if you need to reschedule.

Limitation of Liability

Red Valley Excavation is not liable for damage to underground utilities, pipes, cables, or other buried objects that were not properly marked or disclosed prior to excavation. We exercise reasonable care but cannot guarantee against damage to unmarked utilities.

Our liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.

Insurance

Red Valley Excavation maintains general liability insurance for our operations. Proof of insurance is available upon request.

Intellectual Property

All content on this website, including text, images, logos, and design elements, is the property of Red Valley Excavation and is protected by copyright and trademark laws. You may not reproduce, distribute, or use our content without written permission.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Utah. Any disputes arising from these terms or our services shall be resolved in the courts of Washington County, Utah.
